Terms of Service

1. Acceptance of terms

By accessing or using HiveGigz (hivegigz.com), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

These terms apply to all visitors, registered users, employers, job seekers, and freelancers who access or use the platform in any way.

2. The platform

HiveGigz is an online marketplace that connects:

• Employers and recruiters posting job vacancies, gigs, and hiring requests.
• Job seekers browsing and applying for roles.
• Freelancers and skilled individuals offering services and talents.

HiveGigz acts as a platform only. We are not an employment agency and do not guarantee job placement, hiring outcomes, or the quality of any listed opportunity.

3. Accounts

• You must meet the minimum age to use online services in your country (for example 18 in Kenya, 16 in the United States).
• You are responsible for maintaining the security of your account and password.
• You must provide accurate and truthful information when registering.
• One person may not maintain more than one active account without permission.
• You must notify us immediately at support@hivegigz.com if you suspect unauthorised access to your account.
• HiveGigz is not liable for any loss or damage resulting from your failure to keep your account secure.

4. Employers & recruiters

If you post a job, gig, or hiring request on HiveGigz you agree that:

• The listing is genuine and for a real opportunity.
• You will not post misleading, false, or discriminatory listings.
• You will not use applicant data for purposes unrelated to the listed role.
• You are responsible for complying with all applicable employment laws in your jurisdiction.
• Paid listings are subject to our listing fees and payment terms (see Section 9).
• HiveGigz reserves the right to remove any listing that violates these terms without refund.

5. Job seekers & freelancers

If you apply for jobs or post talent/service listings you agree that:

• Information in your profile, CV, and applications is accurate and your own.
• You will not misrepresent your qualifications, experience, or identity.
• You will communicate with employers professionally and in good faith.
• HiveGigz does not guarantee you will receive job offers or interview invitations.

6. Prohibited conduct

You must not use HiveGigz to:

• Post spam, fake listings, or scam opportunities.
• Collect other users' data without consent (scraping, harvesting).
• Harass, threaten, or abuse other users via the messaging system.
• Impersonate another person, company, or brand.
• Post content that is illegal, discriminatory, defamatory, or obscene.
• Attempt to gain unauthorised access to any part of the platform.
• Use automated bots or scripts to interact with the platform without written permission.
• Circumvent any fees by conducting transactions agreed through HiveGigz off the platform to avoid payment.

Violation of these rules may result in immediate account suspension or permanent ban.

7. Your content

You retain ownership of content you post (job listings, profile information, messages, portfolio items).

By posting content on HiveGigz, you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute that content as needed to operate the platform (e.g. showing your listing to job seekers).

You are solely responsible for the content you post. HiveGigz does not endorse user-generated content and is not liable for it.

8. Intellectual property

All HiveGigz branding, logos, design, code, and original content are the intellectual property of HiveGigz. You may not copy, reproduce, or distribute them without written permission.

The HiveGigz name, bee mascot, and "Hive" brand elements are proprietary to HiveGigz — and yes, the bee showed up after we chose the name; it is a happy coincidence, not a secret beekeeping operation.

9. Payments & listings

• Some listing types require payment (promoted listings, featured slots).
• Fees are set in KES (Kenyan Shillings). Where we show prices in your local currency, that is an approximate guide only (for example 1 USD ≈ 126 KES) — the amount you confirm at checkout is what you pay.
• Available payment methods depend on your location (for example M-Pesa / KCB in Kenya, and others as listed at checkout).
• All fees are non-refundable unless a listing is removed by HiveGigz due to a platform error.
• Advertising placements are subject to a separate advertising agreement and invoice.

10. Limitation of liability

HiveGigz provides the platform "as is" without warranties of any kind. To the maximum extent permitted by law:

• We do not guarantee the platform will be error-free or always available.
• We are not liable for any hiring decisions made by employers or freelancers.
• We are not liable for any loss of earnings, opportunities, or data resulting from use of the platform.
• Our total liability to you shall not exceed the amount you paid to HiveGigz in the 3 months preceding any claim.

11. Termination

You may delete your account at any time from Settings.

HiveGigz reserves the right to suspend or terminate your account at any time if you violate these terms, without prior notice and without liability.

On termination, your right to use the platform ceases immediately. Content you posted may be removed at our discretion.

12. Governing law

HiveGigz is a global platform. You are also responsible for following the laws that apply where you live and work (including minimum age, employment, and tax rules).

These terms are governed by the laws of Kenya, where HiveGigz is headquartered. Any disputes that cannot be resolved informally shall be subject to the courts of Kenya, without limiting mandatory consumer protections in your country where they apply.

13. Changes to terms

We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of HiveGigz after changes are posted means you accept the updated terms.

For significant changes we will notify registered users by email or via an in-app notice.
